Regulatory fees for the independent healthcare sector

This consultation closed February 2006.

The Healthcare Commission is now responsible for setting the fees that are charged for the regulation of establishments in the independent healthcare sector. We have taken over this responsibility from the Department of Health.

The current fee rates recover 42% of the total cost of registration, inspection and other regulatory activities. In line with HM Treasury and Department of Health guidance, the Commission intends to move to full cost recovery from April 2008.

Our intention is to keep fees as low as possible for the greatest number of providers. We propose to do this by significantly improving our efficiency and reducing our costs. Our proposed fee structure will also require that those establishments needing higher than average levels of intervention will pay higher fees than those able to demonstrate compliance with regulations and standards.

From December 2005 to February 2006, we consulted on our proposed scheme of fees. Our consultation included questions on the proposed categories of providers, fee levels as they are now and in the future, how we calculate our costs including enforcement and prosecution costs, and whether certain providers funded from voluntary contributions should be charged a lower rate.
